On 26.11.2025. the Cantonal Court in Zenica issued a final Judgment annulling the Decision of the Ministry of Education, Science, Culture and Sports of the Canton of Zenica prohibiting the implementation of the Senate's decision on the election and appointment of the Rector of the University of Zenica. This confirmed that the Senate's decision is legal and final, and that the Rector of the University of Zenica is Prof. Dr. Jusuf Durakovi\u0107.<\/p>\n
On the same day, in another administrative case, the Cantonal Court temporarily suspended the proceedings and sent a request to the Constitutional Court of Bosnia and Herzegovina for an evaluation of the constitutionality of several provisions of the Law on the Public Institution University of Zenica and the Law on Higher Education ZDK, especially in the part related to the authority of the Board of Directors to dismiss the rector and the composition and dominance of the founders in the governing bodies.<\/p>\n
On November 24, 2025, the Municipal Court in Zenica also requested a review of the constitutionality of several articles of the Law on Higher Education of the Canton of Zenica with the Framework Law on Higher Education of BiH and the Constitution of BiH.<\/p>\n
These proceedings clearly raise the question of whether the legal solutions in the ZDC violate the autonomy of universities and exceed the powers that belong to the academic community. The court decisions confirm that the legally prescribed powers of the Senate and academic self-government as the foundation of the higher education system must be respected.<\/p>\n
